Major Companies in Talk With TVM Lawsuit

Transvaginal mesh is a net-like device that was originally used in the surgical procedures to treat hernias. More recently, manufacturers of these meshes began to market the device as a method of permanently treating pelvic organ prolapse (POP) and Stress Urinary Inconsistence (SUI).

POP is a condition that is common in women after hysterectomy or child birth when the pelvic floor muscles are weakened, causing one or more pelvic organs to drop from their intended position. The mesh reinforces the pelvic region and prevents these organs from dropping. The mesh can either be manufactured from biological materials or synthetic raw materials. However, there have been plenty of adverse reports associated with the mesh implant.

Till date, over 100,000 transvaginal mesh lawsuits have been filed and some of which resulted in multi-million dollar verdicts. Given its stature of settlements, TVM lawsuits are shaping up to be one of the largest medical device mass torts in history.

According to the mesh lawsuit update, several manufacturers of vaginal mesh implants, such as C.R. Bard, are in talks to settle thousands of lawsuits which are pending in MDLs.

The companies involved are accused of designing and manufacturing defective and dangerous products which in place of treating POP and SUI resulted in vaginal erosion and other complications.

Bard’s pelvic mesh products are at the center which has more than 12,000 lawsuits. Boston Scientific is facing a similar number of claims as per the mesh lawsuit updat. The American Medical Systems is looking at around 13,500 lawsuits till date; Cook and Coloplast have around 1,000 claims between them.

Reports from Bloomberg reveals the five major manufacturers - C.R. Bard, Endo Health Solutions (American Medical Systems), Boston Scientific Corp., Coloplast and Cook Medical are reportedly involved in the talks about a mass settlement.

The common factors that a jury generally considers while determining the compensation are as follows:

•    The extent and duration of the injury suffered from the mesh implant

•    The overall effect of the mesh injury on the physical and mental
health or well-being of the plaintiffs

•    Understanding the mental anguish suffered in the past and is likely to be suffered in the future

•    Medical expenses incurred during the past or future because of the mesh complications

•    Any lost wages or loss of earning capacity in future.
